Recently, the Central Committee of the Communist Party of China issued the "Regulations on Political and Legal Work of the Communist Party of China" and issued a notice requiring all regions and departments to earnestly comply with them. The full text of the Regulations of the Communist Party of China on Political and Legal Work is as follows.

 

Chapter I General Provisions

 

Article 1 In order to uphold and strengthen the party's absolute leadership over political and legal work, and do a good job in the party's political and legal work in the new era, these regulations are formulated in accordance with the "Articles of the Communist Party of China", the "the People's Republic of China Constitution" and relevant laws.

Article 2 These Regulations apply to the leadership and organization of political and legal work of the central and local party committees, political and legal committees of party committees, and political and legal units (party committees).

Article 3 political and legal work is an important part of the work of the party and the state, and an important way and way for the party to lead political and legal units to perform their dictatorship, management and service functions in accordance with the law.

The political and legal committee of the Party committee is the functional department of the Party committee to lead and manage the political and legal work, and is an important organizational form to realize the party's leadership over the political and legal work.

Political and legal units are specialized forces engaged in political and legal work under the leadership of the party, mainly including judicial organs, procuratorial organs, public security organs, national security organs, judicial administrative organs and other units.

Article 4 Political and legal work must adhere to the guidance of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thinking of the "Three Represents", the scientific development concept, and Xi Jinping's new era of socialism with Chinese characteristics, and firmly establish political awareness, overall awareness, and core Consciousness, alignment consciousness, firm confidence in the path of socialism with Chinese characteristics, theoretical confidence, institutional confidence, and cultural confidence, and resolutely maintain the core position of General Secretary Xi Jinping's Party Central Committee, resolutely safeguard the authority of the Party Central Committee and centralized and unified leadership, focus on the overall layout of the "five in one" and coordinate the promotion of the "four comprehensive" strategic layout, adhere to the organic unity of party leadership, the people being the masters of the country, and the rule of law, and resolutely defend the party's Leadership and the socialist system with Chinese characteristics, safeguard the authority of the Constitution and law, support political and legal units in performing their duties in accordance with the law, and ensure that the judicial organs independently and, ensure that the political and legal team fully and correctly fulfills the mission of builders and defenders of the cause of socialism with Chinese characteristics.

Article 5 The main tasks of political and legal work are: to carry out work under the strong leadership of the Party Central Committee with Comrade Xi Jinping as the core, promote the construction of a safe China and a rule of law China, promote the comprehensive deepening of reforms in the political and legal field, strengthen the construction of strong teams, and deepen the construction of intelligence. Strict law enforcement, fair justice, and perform the main duties of safeguarding national political security, ensuring overall social stability, promoting social fairness and justice, and ensuring people's living and working in peace, create a safe political environment, a stable social environment, a fair legal environment, and a high-quality service environment to enhance the people's sense of gain, happiness, and security.

Article 6 The following principles shall be observed in the work of politics and law:

(I) uphold the party's absolute leadership and implement the party's leadership in all aspects and the entire process of political and legal work;

(II) persist in taking the people as the center, combining specialized work with the mass line, and safeguarding the legitimate rights and interests of the people;

(III) unswervingly follow the road of socialist rule of law with chinese characteristics and build a socialist country ruled by law;

(IV) insist on serving and ensuring the overall situation, and provide a legal guarantee for promoting sustained and healthy economic development and maintaining long-term social stability;

(V) adhere to the overall concept of national security and safeguard national sovereignty, security and development interests;

(VI) strictly distinguish and correctly handle contradictions between the enemy and ourselves and contradictions among the people, which are two types of contradictions of different nature, and accurately exercise the functions of the people's democratic dictatorship;

(VII) adhere to the path of socialist social governance with Chinese characteristics and promote the formation of a social governance pattern of co-construction, co-governance and sharing;

(VIII) persist in reform and innovation, and build and improve the socialist judicial system with Chinese characteristics and the institutional mechanism for the operation of political and legal work;

(IX) political and legal units divide their responsibilities, cooperate with each other, and check each other in accordance with the law to ensure that they correctly perform their duties and exercise their powers in accordance with the law;

Chapter II The Party Central Committee's Absolute Leadership over Political and Legal Work

 

Article 7 The Party Central Committee shall exercise absolute leadership over political and legal work, decide on major policies for political and legal work, make decisions and deploy major measures related to the overall and long-term development of political and legal work, manage political and legal work and major matters that are under the responsibility of the central government.

Article 8 The Party Central Committee shall strengthen the overall leadership of political and legal work:

(I) adhere to the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, and provide fundamental follow for political and legal work to adhere to the correct direction;

(II) establish the political stand, political direction, political principles and political road of political and legal work, strictly enforce political discipline and political rules, and provide political guarantee for the scientific development of political and legal work;

(III) study and deploy major policies, reform measures, and special actions in political and legal work that have a bearing on national political security, overall social stability, social fairness and justice, and people's living and working in peace and contentment;

(IV) strengthen the organizational construction of the political and legal system and the construction of party style and clean government, lead and promote the construction of a loyal, clean and responsible high-quality professional political and legal team, and provide organizational guarantees for political and legal work.

 

Chapter III Leadership of Local Party Committees over Political and Legal Work

 

Article 9 Local party committees at or above the county level shall lead the political and legal work in their respective regions, implement the major policies of the Party Central Committee on political and legal work, and implement the decisions, decision-making arrangements, and instructions of the Party Central Committee and higher-level party organizations on political and legal work.

Article 10 Local Party committees at or above the county level shall, on the premise of implementing the spirit of the Party Central Committee, implement leadership responsibilities for the following matters in the political and legal work of the region:

(I) the overall planning of political and legal work is an important matter related to the maintenance of national security, especially political security with the security of the regime and the security of the system as the core;

(II) make overall plans to maintain social stability, and promptly and properly handle important matters and emergencies that affect social stability;

(III) the overall planning of safety construction, legal construction and economic and social development, so as to achieve the same deployment, promotion, supervision, assessment, reward and punishment;

(IV) promote political and legal units to maintain the order of the socialist market economy in accordance with the law and provide legal guarantees for high-quality economic development;

(V), organize and implement the party Central Committee's plan for political and legal reform, and promote the improvement of the socialist judicial system and the operating system and mechanism of political and legal work;

(VI) and improve the social governance system of party committee leadership, government responsibility, social coordination, public participation, and legal protection, and improve the level of socialization, rule of law, intelligence, and specialization of social governance;

(VII) and improve the supervision mechanism of the party committee, discipline inspection and supervision organs, and the political and legal committees of the party committee over political and legal units, ensure the implementation of the party's line, principles and policies and the major decisions and arrangements of the party Central Committee, and ensure the correct and unified implementation of the Constitution and laws;

(VIII) strengthen the party's leadership over the construction of the political and legal team, and improve the work pattern of the construction of the political and legal team under the unified leadership of the party committee, with the political and legal units taking charge of the work, and the relevant departments performing their respective duties;

(IX) improve the judicial conditions for law enforcement to meet the needs of the situation and tasks of political and legal work;

(X) promote the improvement and implementation of systems and policies to ensure that political and legal police officers perform their duties and carry out their work in accordance with the law;

Chapter IV Leadership of the Political and Legal Committee of the Party Committee

 

Article 11 The central and local party committees at or above the county level shall establish political and legal committees. The Central Political and Legal Committee's functional configuration, internal institutions and staffing plans are approved and determined by the Party Central Committee. The functional configuration, internal institutions and staffing regulations of the political and legal committees of local party committees shall be determined by the party committees at the same level in accordance with the spirit of the Party Central Committee and the requirements of the party committees at the next higher level, combined with the actual examination and approval of the region.

The township (street) party organization is equipped with political and legal committee members to carry out work under the leadership of the township (street) party organization and the guidance of the county-level party committee political and legal committee.

The comprehensive social security management center of provinces, cities, counties, and townships (streets) is an important work platform for integrating social governance resources and innovating social governance methods. The political and legal committees of the party committees at the same level and the township (street) political and legal committees are responsible for work coordination and policy guidance.

Article 12 in performing its duties and carrying out its work under the leadership of the Party committee, the political and legal committee of the Party committee shall grasp the political direction, coordinate the functions of all parties, coordinate the political and legal work, build the political and legal team, supervise and urge the performance of duties according to law, create a fair judicial environment, take the lead in handling affairs according to law, ensure the implementation of the party's line, principles and policies and major decisions of the Party Central Committee, and ensure the correct and laws. The main duties and tasks are:

(I) and implement Xi Jinping's thoughts on socialism with Chinese characteristics in the new era, adhere to the party's absolute leadership over political and legal work, resolutely implement the party's line, principles and policies and major decisions and deployments of the Party Central Committee, and promote the improvement and implementation of the political rotation training and political supervision system.

(II) implement the decisions of the Party Central Committee and higher-level party organizations, study and coordinate major issues between political and legal units, between political and legal units, relevant departments, and localities, and unify the thinking and actions of political and legal units.

(X) fulfill other tasks assigned by the party committee and the political and legal committees of higher-level party committees.

Article 13 The political and legal committees of the central and local party committees at all levels guide, support, and urge political and legal units to carry out their work within the scope of their duties as prescribed by the Constitution and laws.

The Central Political and Legal Committee guides the work of the political and legal committees of local party committees at all levels, and the political and legal committees of higher-level party committees guide the work of the political and legal committees of lower-level party committees.

 

Chapter V Leadership of Party Groups (Party Committees) in Political and Legal Units

 

Article 14 The party group (party committee) of a political and legal unit shall lead the political and legal work of the unit or the system, implement the Party Central Committee's major policies on political and legal work, and implement the decisions, decision-making arrangements, and instructions of the Party Central Committee and higher-level party organizations on political and legal work.

Article 15 The party group (party committee) of a political and legal unit shall, in leading and organizing the development of political and legal work, set the direction, manage the overall situation, ensure implementation, and play a leading role. The main duties and tasks are:

(I) and implement Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, implement the Party's line, principles and policies and major decisions and deployments of the Party Central Committee, and maintain the Party's absolute leadership over political and legal work;

(II) abide by and implement the Constitution and laws, take the lead in performing their duties in accordance with the law, promote strict law enforcement and fair administration of justice, and safeguard the unity, dignity and authority of the country's legal system;

(III) study major matters or major cases that affect the country's political security and social stability, and formulate principles, policies and measures for handling them according to law;

(IV) research and promote the comprehensive deepening of reforms of the unit or the system, study and formulate the law enforcement and judicial policies of the unit or the system, and improve the quality, efficiency and credibility of law enforcement and justice;

(V) fulfill the main responsibility of administering the party strictly in an all-round way, and strengthen the party building and the political and legal team building of the unit or system;

(VI) fulfill other tasks assigned by the higher-level party group (party committee) and the political and legal committee of the party committee.

Article 16 The party group (party committee) of political and legal units shall establish and improve the system of playing a leading role in law enforcement and case handling, and the party group (party committee) members participate in important business and important decision-making systems in accordance with working procedures, and strengthen the political leadership and law of the party group (party committee) and its members. Chapter VI Request for Instructions Report

 

Article 17 The Central Political and Legal Committee and the Party Group (Party Committee) of the Central Political and Legal Unit shall perform their duties and carry out their work under the leadership of the Party Central Committee, be responsible to the Party Central Committee, be supervised by the Party Central Committee, and request instructions from the Party Central Committee and the General Secretary to report on their work.

The Central Political and Legal Committee, the party group (party committee) of the central political and legal unit, and the local party committee at or above the county level, the party committee political and legal committee, and the party group (party committee) of the political and legal unit strictly implement the request and report system in accordance with the relevant provisions of the Party Central Committee on major issues.

The party group (party committee) of a political and legal unit shall request instructions from the party committee at the same level to report on major matters and important work, and shall generally copy it to the political and legal committee of the party committee at the same level.

　　

Article 18 The Central Political and Legal Committee and the Party Group (Party Committee) of the Central Political and Legal Unit shall promptly ask the Party Central Committee for instructions on the following matters:

(I) major principles and policies for political and legal work, and major issues related to the overall situation and long-term development of political and legal work;

(II) the maintenance of national security, especially the major political security issues with regime security and system security as the core;

(III) major issues in the work of maintaining social stability;

(IV) major structural reform plans and major legislative proposals for political and legal work;

(V) the major policies and measures to be formulated for the construction of political and legal personnel;

(VI) other major issues in political and legal work.

Article 19 The Central Political and Legal Committee and the Party Group (Party Committee) of the Central Political and Legal Unit shall promptly report the following matters to the Party Central Committee:

(I) the important progress and results of the implementation of major issues such as the decisions, decision-making arrangements, and instructions of the Party Central Committee;

(II) reports on the investigation and study of major issues affecting the correct and unified implementation of the party's line, principles and policies, and the constitution and laws;

(III) the important progress and results of major emergencies (incidents) with national impact;

(IV) a major move to strengthen the building of the political, legal, and judicial ranks;

(V) six months and annual work;

(VI) other matters required to be reported by the party central committee.

The overall situation of political and legal work and the major matters handled or coordinated by the Central Political and Legal Committee shall be uniformly reported to the Party Central Committee by the Central Political and Legal Committee, and the central political and legal units shall assist in the relevant work.

The Party Group of the Supreme People's Court and the Party Group of the Supreme People's Procuratorate strictly implement the system of reporting work to the Party Central Committee in accordance with relevant regulations.

The party committees of all provinces (autonomous regions and municipalities directly under the Central Government) shall, in accordance with relevant regulations, ask the Party Central Committee for instructions and report on major issues of political and legal work.

Article 20 The party group (party committee) of the central political and legal unit and the political and legal committee of the party committee of the province (autonomous region, municipality) shall ask the Central Political and Legal Committee for instructions on the following matters:

(I) major matters that involve the overall situation of political and legal work and need to be submitted to the Central Commission of Political Science and Law for study and decision;

(II) the existence of differences between the regions and departments concerned, the inability to reach agreement after repeated consultations, and the need for coordination by the Central Commission of Political Science and Law;

(III) major political and legal reform programs and measures;

(IV) and promulgate important law enforcement judicial policy documents and judicial interpretations, and put forward legislative proposals involving major institutional and major policy adjustments;

(V) major issues assigned by the party central committee and major issues that require the central commission of political science and law to study and grasp principles and policies as a whole;

(VI) the issue of policies and measures related to major issues involving national security, especially political security, in political and legal work;

The (VII) intends to convene a meeting or issue a document in the name of the Central Commission of Political Science and Law;

(VIII) other major matters that should be asked for instructions from the Central Committee of Political Science and Law.

Article 21 The party group (party committee) of the central political and legal unit and the political and legal committee of the provincial (autonomous region, municipality) party committee shall report the following matters to the Central Political and Legal Committee:

(I) the comprehensive implementation of the party's basic theory, basic line, and basic strategy, and the implementation of the party central committee's decisions and deployments;

(II) the implementation of the spirit of the Party Central Committee's important instructions on political and legal work;

(III) the implementation of the work arrangements, instructions and decisions of the Central Commission of Political Science and Law;

(IV) major work arrangements and progress, and annual work;

(V) the deployment of major political and legal reforms and their progress;

(VI) the handling of major matters involving national security, especially political security, in political and legal work;

(VII) the implementation of the main responsibility of administering the party strictly in an all-round way, and the implementation of the responsibility system for party building, the responsibility system for building a clean and honest party style, and the responsibility system for ideological work in the field of politics and law;

(VIII) leading cadres to interfere in judicial activities and in the handling of specific cases;

(IX) other matters that should be reported to the Central Commission of Political Science and Law.

Article 22 The political and legal committees of local party committees at or above the county level and the party groups (party committees) of political and legal units shall report their overall work to the party committees at the same level every year, and promptly ask for instructions and reports in case of important situations.

The political and legal committee of the local party committee shall, with reference to the relevant provisions of the political and legal committee of the party committee at the next higher level, determine the scope, content, and procedures of the party group (party committee) of the political and legal unit at the same level and the political and legal committee of the party committee at the lower level.

 

Chapter VII Decision-making and Implementation

 

Article 23 The party committee, the political and legal committee of the party committee, and the party group (party committee) of the political and legal unit shall, in accordance with the principles of collective leadership, democratic centralization, individual deliberation, and meeting decisions, within the scope of their respective duties and powers, timely study and make decisions, decision-making arrangements or instructions on the following matters:

(I) important matters involving the implementation of the decisions, policy-making arrangements, and instructions of the Party Central Committee, higher-level party organizations, and the political and legal committees of the Party Committee on political and legal work;

(II) important matters to be reported by lower-level party committees, political and legal committees of party committees, and leading party groups (party committees) of political and legal units;

(III) the matters that the unit needs to make decisions in the performance of its duties.

When making decisions, it shall first investigate and study, put forward appropriate plans, fully listen to the opinions of all parties, conduct risk assessment and legal compliance review, and submit them to relevant meetings for discussion and decision in accordance with regulations.

Article 24 with regard to the decisions, decision-making arrangements, and instructions of the party Central Committee and party organizations at higher levels, all relevant local party committees, political and legal committees, and party groups (party committees) of political and legal units must resolutely implement them.

The party committee, the political and legal committee of the party committee, and the party group (party committee) of the political and legal unit that submitted the request report, in the process of implementing the decisions, decision-making arrangements, and instructions of the party Central Committee and the party organization at a higher level, if they believe that the original request report needs to be adjusted, it must be based on who makes the decision. The principle of who approves the approval shall be submitted to the original decision, but it should be resolutely implemented before approval.

　　

Article 25 The local party committee shall establish and improve the system of committee plenary meetings or standing committee meetings to study and deploy political and legal work, put political and legal work on the important agenda, and promptly study and solve major issues in political and legal work and team building.

Article 26 the local Party committee shall take the lead in implementing the decisions, decision-making arrangements and instructions of the Party Central Committee and the party organizations at higher levels in their respective regions, and guide and urge the political and legal committees of the Party committees and the Party groups (Party committees) of political and legal units to do a good job in the implementation of relevant work.

Members of local party committees should resolutely implement the collective decisions of party committees; if they have different opinions, they can retain them or reflect them to higher party organizations, but they should resolutely implement them before the decision is changed.

　　

Article 27 the political and legal committee of the Party committee shall implement the plenary meeting system to discuss and decide on major issues of political and legal work within the scope of its duties.

Article 28 the political and legal committee of the Party committee shall implement the decisions, decision-making arrangements and instructions of the Party Central Committee, the local Party committee at the same level and the political and legal committee of the Party committee at the higher level, and play the role of overall coordination, Assist the Party committee to guide and supervise the Party group (Party committee) of the relevant political and legal units and the political and legal committees of the Party committee at the lower level to resolutely implement the decisions, decision, decision-making deployment and instructions of the Party Central Committee and higher level.

Article 29 The party group (party committee) of a political and legal unit shall convene a party group (party committee) meeting in accordance with relevant regulations to discuss and decide on major issues of political and legal work and team building in the unit or system.

Article 30 The party group (party committee) of a political and legal unit shall resolutely implement the decisions, decision-making arrangements, and instructions of the Party Central Committee and higher-level party organizations to ensure the implementation of the work.

Members of the leading party group (party committee) of political and legal units should resolutely implement the collective decisions of the leading party group (party committee); if they have different opinions, they can retain or reflect them to the party organization at a higher level, but they should resolutely implement them before the decision is changed.

 

Chapter VIII Supervision and Responsibility

 

Article 31 Party committees at all levels shall incorporate the leadership and organization of political and legal work into the inner-party supervision system, implement the combination of inner-party supervision and external supervision, and enhance the joint force of supervision.

The Political and Legal Committee of the Party Committee should guide and promote political and legal units to establish and improve a supervision and restriction system that is compatible with the operation mechanism of law enforcement judicial power, build a law enforcement judicial responsibility system with clear powers and responsibilities, and improve procedural, platform, and open management and supervision methods.

The party group (party committee) of political and legal units shall incorporate political and legal work into the scope of party affairs and government affairs disclosure in accordance with laws and regulations, and promote the disclosure of trial execution, procuratorial affairs, police affairs, judicial administration, and prison (office) affairs in an orderly manner in accordance with the law, and improve political and legal units The inter-party supervision and restriction mechanism ensures that political and legal work is promoted under effective supervision and restraint in accordance with the law.

Article 32 Strengthen the supervision and inspection of the overall situation of political and legal work and the implementation of major decisions and deployments:

The (I) party committee should strengthen the supervision and inspection of the political and legal work carried out by the party committee's political and legal committee, the party group (party committee) of the political and legal unit, and the next-level party committee, especially the implementation of the decisions, decision-making arrangements, and instructions of the party Central Committee and higher-level party organizations. Carry out inspections and notifications within a certain range;

The Political and Legal Committee of the (II) Party Committee should promote the improvement and implementation of political supervision, law enforcement supervision, discipline style supervision and inspection and other work systems and mechanisms, and comprehensively promote the implementation of political and legal work, especially the decisions, decision-making arrangements, and instructions of the Party Central Committee and higher-level party organizations;

The party group (party committee) of (III) political and legal unit shall establish and improve the comprehensive reporting system to the party committee that approved its establishment and the supervision and feedback mechanism for the implementation of major decisions, to ensure that the decisions, decision-making arrangements, and instructions of the party Central Committee and the party organization at a higher level are implemented in the unit or the system.

Article 33 The party committee shall strengthen the evaluation and assessment of the performance of the political and legal committees of the party committees, the party groups (party committees) of political and legal units, and the standing committees of the party committees at the next level, and the results shall be used as an important content and basis for the comprehensive evaluation and evaluation of the relevant leadership groups and leading cadres:

(I) in conjunction with the annual assessment of the leadership team, democratic life meetings, etc., regularly inspect and evaluate the performance of the party committee's political and legal committee;

(II) establish and improve the system of listening to the main responsible persons of the party leading group (party committee) of political and legal units, and strengthen the evaluation and assessment of the performance of the party leading group (party committee) and its members of political and legal units;

When assessing the work carried out by the leaders of the Standing Committee of the Party Committee at the next level, the (III) pays attention to understanding the leadership's political and legal work.

The political and legal committee of the party committee shall establish and improve the system of reporting on the work of the committee members, fully understand and grasp the performance of the committee members, and put forward guiding opinions in a timely manner.

Article 34 The Political and Legal Committee of the Party Committee, in coordinating and promoting the normal law enforcement and judicial standardization inspections of political and legal units, has found that the party group (party committee) and its members of the political and legal unit fail to perform or incorrectly perform their duties, or the outstanding problems in the law enforcement and justice of the political and legal officers., Should supervise and intensify rectification efforts, strengthen the construction of the law enforcement and judicial system, and ensure the full and correct performance of duties.

Article 35: Where relevant local and departmental leading cadres violate these regulations and relevant internal party laws and regulations in leading and organizing political and legal work, depending on the severity of the circumstances, the political and legal committee of the party committee shall conduct interviews, notifications, listing supervision, etc.; Or the discipline inspection and supervision organs, organization and personnel departments shall, in accordance with the management authority, handle the resignation, order resignation, removal, etc. Those who should be held responsible for violating discipline and law shall be given party discipline and administrative sanctions; those suspected of committing crimes shall be investigated for criminal responsibility in accordance with the law.

 

Chapter IX Supplementary Provisions

 

Article 36 The Central Political and Legal Committee, the party group (party committee) of the central political and legal unit, and the party committees of all provinces (autonomous regions and municipalities directly under the Central Government) may formulate supporting regulations in accordance with these regulations and in light of their respective actual conditions.

Article 37 The Central Military Commission shall, in accordance with the basic spirit of these Regulations, formulate internal party regulations on military political and legal work.

Article 38 The Central Commission of Political Science and Law shall be responsible for the interpretation of these Regulations.

Article 39 These Regulations shall come into force on January 13, 2019. Any previously issued regulations on political and legal work within the party that are inconsistent with these regulations shall be implemented in accordance with these regulations.
