Chapter II General Rules of Organization

Article 21 The Chinese People's Political Consultative Conference shall establish a National Committee and local committees.

The composition of the local committees of the Chinese People's Political Consultative Conference shall be decided in the light of local conditions and with reference to the composition of the National Committee.

Article 23 All parties and organizations that approve of this constitution may participate in the National Committee of the Chinese People's Political Consultative Conference with the consent of the Standing Committee of the National Committee of the Chinese People's Political Consultative Conference. Those who participate in local committees shall be handled by local committees at all levels in accordance with the above-mentioned provisions of this article.

Article 24 All units and individuals participating in the National Committee or local committees of the Chinese People's Political Consultative Conference shall have the obligation to abide by and perform this Constitution.

Article 26 The bills of the plenary sessions of the National Committee and local committees of the Chinese People's Political Consultative Conference shall be adopted by a majority vote of all members. Article 28 Units and individuals participating in the National Committee and local committees of the Chinese People's Political Consultative Conference shall have the freedom to declare their withdrawal.

Article 29 If units and individuals participating in the National Committee and local committees of the Chinese People's Political Consultative Conference seriously violate the Constitution of the Chinese People's Political Consultative Conference or the resolutions of the plenary meeting and the Standing Committee of the Chinese People's Political Consultative Conference, the Standing Committee of the National Committee or the Standing Committee of the local committee shall be respectively According to the circumstances, a warning shall be given, or his qualification to participate in the National Committee or local committee of the Chinese People's Political Consultative Conference shall be revoked.

A unit or individual that has been given a disciplinary warning or whose qualification to participate has been revoked may request reconsideration if it does not accept the decision.
 

 
Chapter III Members
 

Article 30 members of the National Committee and local committees of the Chinese people's political Consultative Conference shall love the motherland, support the leadership of the Communist Party of China and the socialist cause, safeguard national unity and national unity, abide by the Constitution and laws of the state, keep state secrets, be honest and self-disciplined, be representative in this sector, have social influence and have the ability to participate in and discuss state affairs.

Article 31 The members of the National Committee of the Chinese People's Political Consultative Conference must be decided by the Standing Committee of the National Committee of the Chinese People's Political Consultative Conference through consultation after relevant procedures. The members of the local committees shall, after going through the relevant procedures, be decided by the standing committees of the local committees at all levels through consultation.

Article 32 Members of the National Committee and local committees of the Chinese People's Political Consultative Conference shall actively perform their duties and earnestly exercise their rights in accordance with this Constitution.

Article 33 Members of the National Committee and local committees of the Chinese People's Political Consultative Conference shall have the right to vote, to elect and to be elected at meetings of the CPPCC; they shall have the right to put forward opinions, criticisms and suggestions on the work of the CPPCC.

Article 34 Members of the National Committee and local committees of the Chinese People's Political Consultative Conference shall keep close contact with the masses, understand and reflect their wishes and demands, and participate in meetings and activities organized by the Association.

Article 35 Members of the National Committee and local committees of the Chinese People's Political Consultative Conference shall correctly handle the relationship between personal professional activities and the performance of their duties, and shall not use their status as members to seek the interests of individuals, small groups and specific related parties.

Article 36 The National Committee and local committees of the Chinese People's Political Consultative Conference shall strengthen the management of members' performance of duties, establish members' performance files, and adopt appropriate methods to report the performance of duties.

Article 37 Those who seriously harm the interests of the state and the people, who have been organized, punished or sentenced for serious violations of discipline and law, who are under investigation and handling for suspected violations of discipline and law, and who falsify their identity, shall not be nominated or continue to be nominated as candidates for committee members.

Article 38 If it is inappropriate to continue to serve as a member due to job changes or other reasons, I shall resign as a member. Those who violate social morality or have acts inconsistent with the status of the committee members shall be interviewed or consulted in a timely manner, and if they still fail to make corrections after being reminded, they shall be ordered to resign as members.

Article 39 For members who violate discipline and law, the Standing Committee of the National Committee of the Chinese People's Political Consultative Conference or the Standing Committee of the local committee shall deal with them accordingly in accordance with laws and relevant regulations.

 
Chapter IV National Committees

Article 40 The participating units, the number of members, the number of candidates and the establishment of sectors of the National Committee of the Chinese People's Political Consultative Conference shall be decided by the Standing Committee through consultation after deliberation and approval by the chairman's meeting of the previous National Committee.
 

During the term of office of each National Committee, when it is necessary to increase or change the number of participating units, members, and decide on candidates, the Standing Committee shall make a decision through consultation after deliberation and approval at the current chairmanship meeting.

Article 41 The term of office of the National Committee of the Chinese People's Political Consultative Conference is five years. In case of extraordinary circumstances, the term of office may be extended by a majority of more than 2/3 of all the members of the Standing Committee.

Article 42 The National Committee of the Chinese People's Political Consultative Conference shall have a chairman, a number of vice-chairmen and a secretary-general.
 

Article 43 The plenary session of the National Committee of the Chinese People's Political Consultative Conference shall be held once a year. The Standing Committee may convene temporarily when it deems it necessary.

Article 44 The plenary session of the National Committee of the Chinese People's Political Consultative Conference shall exercise the following functions and powers:

(I) revising the constitution of the cppcc and supervising the implementation of the constitution;

The (II) elects the Chairman, Vice-Chairmen, Secretary-General and Standing Committee members of the National Committee, and decides on the increase or change of the composition of the Standing Committee;

(III) consultation and discussion of the country's major policies and important issues in economic construction, political construction, cultural construction, social construction, and ecological civilization construction, and put forward suggestions and criticisms;

(IV) hear and deliberate the standing committee's work reports, reports on the work of proposals, and other reports;

(V) discuss the major working principles and tasks of the Council and make resolutions.

Article 45 The National Committee of the Chinese People's Political Consultative Conference shall have a Standing Committee to preside over its affairs.

The Standing Committee is composed of the Chairman, Vice-Chairman, Secretary-General and Standing Committee members of the National Committee. Its candidates are nominated through consultation by all parties, groups, ethnic groups and people from all walks of life participating in the National Committee of the Chinese People's Political Consultative Conference, and are elected by the plenary session of the National Committee.

The Standing Committee holds at least two special political meetings each year.

Article 46 The Standing Committee of the National Committee of the Chinese People's Political Consultative Conference shall exercise the following functions and powers:

(I) interpret the constitution of the cppcc and supervise the implementation of the constitution;

The (II) shall convene and preside over the plenary session of the National Committee of the Chinese People's Political Consultative Conference; a preparatory meeting attended by all members shall be held before the first plenary session of each session, and the presidium of the first plenary session shall be elected, and the presidium shall preside over the first plenary session;

(III) organize the fulfillment of the tasks stipulated in the cppcc charter;

(IV) implement the resolutions of the plenary session of the National Committee;

When the plenary session of the (V) National Committee is not in session, it examines and adopts important proposals submitted to the National People's Congress and its Standing Committee or the State Council;

Decide on the members of the National Committee (VI) consultation;
 

(VII) appoint and remove the Deputy Secretary-General of the National Committee of the Chinese People's Political Consultative Conference on the proposal of the Secretary-General;
 

The (VIII) decides on the establishment and changes of the working body of the National Committee of the Chinese People's Political Consultative Conference, and appositions and removes its leading members.

Article 47 The Chairman of the National Committee of the Chinese People's Political Consultative Conference shall preside over the work of the Standing Committee. The Chairman is assisted by the Vice-Chairman and the Secretary-General.

The Chairman, the Vice-Chairmen and the Secretary-General form the Chairman's Meeting to handle the important day-to-day work of the Standing Committee.

The Chairman's Meeting shall be entrusted by the Standing Committee to preside over the preparatory meeting of the first plenary session of the next session.

Article 48 The National Committee of the Chinese People's Political Consultative Conference shall have a number of deputy secretaries-general to assist the secretary-general in his work. Establishment of an office to work under the authority of the Secretary-General.

Article 49 The National Committee of the Chinese People's Political Consultative Conference shall, in accordance with the needs of its work, establish a number of special committees and other working bodies, which shall be decided by the Standing Committee. Special committees should play a fundamental role in their work.
 

 
Chapter V Local Committees

Article 50: Provinces, autonomous regions, and municipalities directly under the Central Government shall establish committees of the Chinese People's Political Consultative Conference; autonomous prefectures, cities divided into districts, counties, autonomous counties, cities not divided into districts, and municipal districts. Local committees of the Chinese People's Political Consultative Conference may be established in places where conditions permit.

Article 51 The participating units, the number of members, the number of candidates and the setting of sectors of the local committees of each session of the Chinese People's Political Consultative Conference shall be decided by the Standing Committee after deliberation and approval by the chairman meeting of the previous local committee.
 

During the term of office of each local committee, if it is necessary to increase or change the number of participating units, members, and decide on candidates, it shall be decided by the Standing Committee through consultation after deliberation and approval by the chairman meeting of the current local committee.
 

Article 52 The term of office of the local committees of the provinces, autonomous regions, municipalities directly under the Central Government, autonomous prefectures, cities divided into districts, counties, autonomous counties, cities not divided into districts and municipal districts of the Chinese People's Political Consultative Conference is five years.
 

Article 53 The local committees of the Chinese People's Political Consultative Conference at various levels shall have a chairman, a number of vice-chairmen and a secretary-general.
 

Article 54 Plenary sessions of the local committees of the Chinese People's Political Consultative Conference at all levels shall be held at least once a year.
 

Article 55 The plenary sessions of the local committees of the Chinese People's Political Consultative Conference at all levels shall exercise the following functions and powers:

The (I) elects the chairman, vice-chairman, secretary-general and standing committee members of the local committee, and decides on the increase or change of the composition of the standing committee;

(II) hear and deliberate the standing committee's work reports, reports on the work of proposals, and other reports;
 

(III) discussion and adoption of relevant resolutions;

(IV) participate in the discussion of important issues of national and local affairs, making suggestions and criticisms.

Article 56 The local committees of the Chinese People's Political Consultative Conference at all levels shall have standing committees to preside over their affairs.
 

The standing committee is composed of the chairman, vice-chairman, secretary-general and standing committee members of the local committee. Its candidates are nominated by the parties, groups, ethnic groups and people from all walks of life participating in the local committee and elected by the plenary session.

Article 57 The standing committees of the local committees of the Chinese People's Political Consultative Conference shall exercise the following functions and powers:

The (I) shall convene and preside over the plenary meetings of the local committees; a preparatory meeting attended by all members shall be held before the first plenary meeting of each session, and the presidium of the first plenary meeting shall be elected, and the presidium shall preside over the first plenary meeting;

(II) organize the realization of the tasks stipulated in the Constitution of the Chinese People's Political Consultative Conference, national resolutions made by the National Committee and regional resolutions made by local committees at higher levels;

(III) implement the resolutions of the plenary session of the local committee;

When the plenary session of the (IV) local committee is not in session, consider and pass important proposals submitted to the local people's congress and its standing committee or the people's government at the same level;

Decide on local committee members (V) consultation;

(VI) appoint and remove the Deputy Secretaries-General of the Local Committees on the proposal of the Secretary-General;

The (VII) decides on the establishment and changes of the working bodies of local committees, and appoints and dismisses their leading members.

Article 58 The chairmen of the local committees of the Chinese People's Political Consultative Conference at all levels shall preside over the work of the Standing Committee. The Chairman is assisted by the Vice-Chairman and the Secretary-General.

The establishment of the working organs of the local committees of autonomous prefectures, cities divided into districts, counties, autonomous counties, cities not divided into districts and municipal districts shall be decided by the standing committees in accordance with the actual local conditions and work needs.
 

 
Chapter VI Emblem

Article 61 The emblem of the Chinese People's Political Consultative Conference is a five-pointed star, gears and ears of wheat, four red flags and ribbons, a map of China and the earth, "1949" and "Chinese People's Political Consultative Conference.

Article 62 In the emblem of the Chinese People's Political Consultative Conference, a five-pointed star indicates the leadership of the Communist Party of China; gears and wheat ears indicate that they are based on the alliance of workers and peasants; the four red flags and ribbons indicate the great unity of all parties, groups, nationalities and strata; the map of China and the earth indicate the unity of the people of the whole country, including compatriots in the Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan and overseas Chinese compatriots and overseas; "1949" and "Chinese People's Political Consultative Conference" are the birth time and name respectively.

Article 63 All units and individuals participating in the Chinese People's Political Consultative Conference shall safeguard the dignity of the emblem. To make and use the emblem in accordance with the regulations.
