The Central Organization Department and other four departments issued the "Opinions on Regulating the Practice of Civil Servants after Resignation from Public Service"

Recently, the Central Organization Department, the Ministry of Human Resources and Social Security, the State Administration for Industry and Commerce, and the State Civil Service Bureau jointly issued the "Opinions on Regulating the Practice of Civil Servants after Resignation from Public Service."

The Opinions stipulate that civil servants who are members of the leadership team of the original department at all levels and other civil servants holding positions at or above the county level shall not accept enterprises, intermediaries or other companies within the jurisdiction and business scope of the original position within 3 years after resigning from public office. For the appointment of profit-making organizations, individuals shall not engage in profit-making activities directly related to the business under the jurisdiction of the original position; within 2 years after other civil servants resign from public office, it is not allowed to accept the appointment of enterprises, intermediary agencies or other profit-making organizations directly related to the original work business, and individuals are not allowed to engage in profit-making activities directly related to the original work business.

The Opinions require that when civil servants apply to resign from public office, they should truthfully report their employment whereabouts, sign a letter of commitment, and take the initiative to report changes in employment within the employment restriction period; the original unit of civil servants should talk to themselves before approving the resignation of public office, understand their employment intentions, and remind them Strictly abide by the restrictions on employment; the competent department of civil servants must establish and improve the registration and supervision and inspection system for civil servants to resign, to guide, supervise and inspect the implementation of the regulations on resignation from public office by various organs; the industrial and commercial and market supervision departments shall impose corresponding penalties on the verified illegal employees and the receiving enterprises.

The "Opinions" emphasized that it is necessary to accurately grasp and implement policies, correctly treat civil servants' resignation from public office in accordance with the law, support the reasonable flow of talents, and fully respect and protect the rights and interests of resigned public officials in legal employment and entrepreneurship.

The "opinion" is an important measure to implement the requirements of comprehensively and strictly administering the party and cadres, and to improve the supervision and restraint mechanism of civil servants. In the next step, the competent departments of civil servants at all levels and the industrial and commercial market supervision departments will, in accordance with the requirements of the opinions, strengthen the supervision and inspection of the employment behavior of civil servants after resigning from public office.
