The Central Committee of the Communist Party of China issued the "Regulations on the request for instructions and reports on major matters of the Communist Party of China"


 

Recently, the Central Committee of the Communist Party of China issued the "Regulations on Requests and Reports on Major Issues of the Communist Party of China" (hereinafter referred to as the "Regulations"), and issued a notice requiring all regions and departments to earnestly comply with them.

 

The notice pointed out that the request and report system is an important political discipline, organizational discipline, and work discipline of our party. It is an effective working mechanism for implementing democratic centralism. It is for resolutely maintaining the core position of General Secretary Xi Jinping's Party Central Committee and the core position of the entire party. It is of great significance to maintain the authority and centralized leadership of the Party Central Committee and ensure the unity and unity of the whole party. The formulation and promulgation of the "Regulations" is conducive to improving the institutionalization, standardization, and scientific level of requesting instructions and reporting on major issues.

 

The notice requires that party organizations at all levels should earnestly organize and study the "Regulations" so that the majority of party membersCadres accurately grasp the significance, basic principles, main contents, and work requirements of the report on major issues, and strengthen their ideological and action consciousness. Leading cadres at all levels must earnestly assume political responsibilities and ensure that their localities and departments strictly follow the subjects, matters, procedures, and methods stipulated in the "Regulations" and earnestly do a good job in requesting instructions and reports. All central departments and party groups (party committees) of central state organs should take the lead in implementing the "Regulations," earnestly strengthen the work of requesting instructions and reports from the Party Central Committee, and strengthen guidance on the work of requesting instructions and reports in this field in the system in accordance with the requirements of the "Regulations. It is necessary to strengthen the supervision and inspection of the implementation of the regulations to ensure that all provisions are implemented to the letter.

 

The full text of the Regulations of the Communist Party of China on Request for Instructions and Reporting on Major Matters is as follows.

 

Chapter I General Provisions

 

Article 1 in order to strengthen and standardize the work of asking for instructions and reporting on major issues, strictly enforce the party's political discipline, organizational discipline and work discipline, and ensure that the whole party and the whole country obey the Party Central Committee and the smooth flow of government orders, these regulations are formulated in accordance with the Constitution of the Communist Party of China, some guidelines on Inner-Party Political Life under the New situation and other inner-party laws and regulations.

Article 2 The work of requesting instructions and reporting on major issues is guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, adheres to and strengthens the overall leadership of the party, insists that the party must manage the party, administer the party strictly, implement democratic centralism, and resolutely safeguard General Secretary Xi Jinping The core of the Party Central Committee and the core position of the whole party, resolutely safeguard the authority of the Party Central Committee and centralized and unified leadership, ensure that the unity and unity of the whole party and action.

Article 3 These Regulations apply to activities related to lower-level party organizations to higher-level party organizations, as well as party members and leading cadres requesting instructions from party organizations to report major matters.

The major matters mentioned in these regulations refer to important matters and important situations that are beyond the scope of the party organization, party members, and leading cadres, or that are within the scope of their own powers but are related to the overall situation and have a wide range of influence, including the party organization's implementation of the Party Central Committee's decision-making and deployment And higher-level party organizations decide, lead economic and social development affairs, implement the responsibility of comprehensively and strictly governing the party, and party members perform their obligations, and important matters and important situations in which leading cadres exercise their power and shoulder their responsibilities.

The term "request for instructions" as mentioned in these regulations refers to the party organization at a lower level to the party organization at a higher level, and party members and leading cadres request instructions or approval from the party organization on major matters; the term "report" refers to the party organization at a lower level to the party organization at a higher level, and the party members and leading cadres report important matters and important situations to the party organization.

Article 4 The following principles shall be followed in carrying out the work of requesting instructions and reporting on major matters:

(I) adhere to the political orientation. We should firmly establish the "Four Consciousness", implement the "four obedience", take the request for instructions and report as an important political discipline and political rules, and implement the political requirements into the whole process and all aspects of the work of the request for instructions and report.

(II) insist on clear rights and responsibilities. Not only keep in mind that the authorization is limited, those who should ask for instructions must ask for instructions, and those who should report must report. At the same time, it is also important to keep in mind that those who are responsible must be responsible and those who are responsible must be responsible.

(III) insist on objective truth. Comprehensively and truthfully ask for instructions and report work, reflect the situation, analyze problems, and put forward suggestions, both good news and bad news, both merit and report, both results and process.

(IV) adhere to norms and orderly. Implement the requirements of governing the party in accordance with regulations, and carry out the work of requesting instructions and reporting on major issues in strict accordance with the subject, scope, procedures and methods stipulated in the party constitution and regulations.

Article 5 The party organizations of all regions and departments shall bear the main responsibility for the work of requesting instructions and reporting on major issues, and the main responsible comrades of the party organizations shall be the first responsible persons and shall be responsible for the work of requesting instructions and reporting.

The General Office of the Central Committee is responsible for accepting and handling major issues for requesting instructions and reports from the Party Central Committee, and coordinating, supervising and guiding the work of requesting instructions and reports from various regions and departments to the Party Central Committee. The general office (office) of the local party committee is responsible for accepting and handling major matters of requesting instructions and reports from the party committee at the corresponding level, and coordinating, supervising and guiding the work of requesting instructions and reports in the region.

 

Chapter II Subject of Party Organization's Request for Instructions and Reports

 

Article 6 The work of requesting instructions and reporting by a party organization shall generally be carried out in the name of the organization, and the higher-level party organization responsible for leadership or supervision and guidance shall be requested for instructions and reports. Under special circumstances, you can ask for instructions and reports on behalf of the party organization in the name of the responsible comrades of the party organization according to work needs.

The request for instructions should be carried out level by level, and generally it is not allowed to go beyond the level. Under special circumstances, you can directly ask for instructions and reports from higher-level party organizations in accordance with relevant regulations.

Article 7 The party organization of a unit that accepts dual leadership shall, according to the nature and content of the matter, request instructions and reports from the higher-level party organization that has the main leadership responsibilities, and at the same time send a copy to the other higher-level party organization. Under special circumstances, it is not possible to copy another higher party organization.

Article 8 The party organization of a unit that accepts centralized leadership and management must obey the leadership of the party organization that approved its establishment, ask for instructions and report to the party organization of the centralized leadership and management unit in accordance with relevant regulations.

Article 9 The party organization of a unit that accepts centralized guidance, coordination or supervision shall generally copy the report to the party organization at a higher level that is responsible for guidance, coordination or supervision.

The party organization of the unit with the responsibility of guidance, coordination or supervision shall coordinate the work of requesting instructions and reporting by the party organizations of all units in the region, field, industry and system under its responsibility, and uniformly request instructions from the party organization at a higher level to report the overall situation and the completion of the leading matters.

Article 10 For major matters involving cross-regional, cross-field, cross-industry, and cross-system, the relevant party organizations shall jointly request instructions and reports to the party organization at a common higher level. The joint request for instructions report should clearly lead the party organization.

If the party and government organs jointly request instructions and report, the party and government organs at a higher level shall generally be listed as the object of the request and report at the same time.

Article 11 in accordance with the provisions of inner-party laws and regulations, the party's decision-making, deliberative and coordinating bodies and the party's working organs may, within the scope of their functions and powers, accept and deal with the requests and reports of lower-level party organizations.

The main responsible comrades of the party organization can accept the request report of the lower-level party organization on the overall work or certain aspects of the work; the relevant responsible comrades can accept the request report of the lower-level party organization on the work in the field in charge, or they can be entrusted by the party organization or the main responsible comrades of the party organization to accept the request report of the lower-level party organization for comprehensive work.

 

Chapter III Matters of Request for Instructions and Reports by Party Organizations

 

Article 12 major principles and policies related to the overall work of the party and the state, major principles and issues in the construction of economic, political, cultural, social and ecological civilization and Party building, matters under the centralized and unified management of the Party Central Committee, such as national security, Hong Kong, Macao and Taiwan overseas Chinese, foreign affairs, national defense and the army, and other major matters that can only be led and decided by the Party Central Committee, We must ask for instructions and report to the Party Central Committee.

Article 13 Party organizations shall ask higher Party organizations for instructions on the following matters:

(I) the important situations and problems in the implementation of the decisions and arrangements of the Party Central Committee and the decisions of higher-level party organizations, policies and measures that need to be adjusted, and special difficulties that need to be supported and resolved;

(II) major reform measures, major legislative matters, major system changes, major project promotion, major emergencies, major institutional adjustments, appointment and removal of important cadres, important commendations and rewards, major violations of discipline and law, and handling of complex and sensitive cases;

(III) clearly stipulate important meetings, important activities and important documents that need to be asked for instructions;

The caliber of propaganda and reporting of major (IV) activities and important policies, and the overall problems and problems that are not easy to grasp in news propaganda and ideological work;

(V) the introduction of major innovative measures, especially when new situations and new problems are encountered and there are no explicit regulations, they need to be tried first, or innovative measures may conflict with existing regulations and require authorization to be implemented;

(VI) matters that fall within the scope of its own authority but are of great importance or special sensitivity;

when major decisions are (VII), there is a big difference of opinion;

(VIII) major issues in cross-regional, cross-field, cross-industry, and cross-system work that need to be promoted by higher-level party organizations;

(IX) adjust the scope of communication and knowledge of the documents and meeting spirit of the party organization at a higher level, and use the undisclosed speeches and audio-visual materials of the responsible comrades of the party organization at a higher level;

(X) other major matters that should be requested.

It is not necessary to ask for instructions from the party organization at a higher level for the following matters: daily work within the scope of its own functions and powers; where the party organization at a higher level has made a clear reply on the relevant issues; matters that can be reported afterwards, and so on.

Article 14 Party organizations shall report the following matters to higher Party organizations:

(I) the important situation of studying and implementing Xi Jinping's thoughts on socialism with Chinese characteristics in the new era, coordinating the promotion of the "five in one" overall layout and coordinating the promotion of the "four comprehensive" strategic layout;

(II) the implementation of important meetings, important documents, and major decision-making arrangements of the CPC Central Committee and party organizations at higher levels, the implementation of General Secretary Xi Jinping's important instructions, and the research and handling of matters assigned by responsible comrades of party organizations at higher levels;

(III) strengthen party building and fulfill the responsibility of administering the party strictly in an all-round way, including centralized study and education activities, ideological work, party organization establishment and subordinate relationship adjustment, democratic life meeting, party style and clean government construction, implementation of the spirit of the eight central regulations, party members and cadres Direct contact with the masses, inspection and rectification, and discovery of major violations of discipline and law;

(IV) a comprehensive work summary and plan;

(V) the development of major special projects;

(VI) the handling of major sensitive events, emergencies and mass incidents;

(VII) the important situations and major public opinions that have emerged in economic and social development;

(VIII) the experience, practices, opinions and suggestions that have the value of promotion in a wider range in the work of the region, the department, and the unit;

(IX) other major matters that should be reported.

The following matters do not need to be reported to the higher party organization: specific transactional work; There is no substantive statement and situation reflection.

Article 15 Party organizations shall, in accordance with the relevant provisions, report the following matters to higher party organizations:

(I) inner-party regulations and normative documents;

(II) the division of labor among members of leading bodies;

(III) the appointment and removal of relevant cadres;

Resignation, removal or automatic termination of office as a member or alternate member of the (IV) Party Committee;

(V) other major matters that should be reported.

Article 16 The central decision-making and coordination agencies, various central departments, and relevant central state organs party groups (party committees) shall put forward clear requirements and strengthen work guidance on specific matters in the field, industry, and system.

Party organizations at higher levels should proceed from reality and put forward requirements for the merger and integration of similar matters with similar themes and related contents in the request reports of party organizations at lower levels, so as to make the request reports concise and pragmatic.

Article 17 The party organization shall, in accordance with the scope and content of the requests for instructions and reports stipulated in these Regulations, and in light of the requirements of the higher authorities and its own reality, formulate a list of requests for instructions and reports.

 

Chapter IV Procedures for Party Organizations to Request Instructions and Report

 

Article 18 The request for instructions on major matters shall generally be collectively studied or passed on for approval by the leadership of the party organization, and issued or made by the principal responsible comrades. When necessary, it shall be reported in advance to the responsible comrades in charge of the party organization at a higher level for approval.

If two or more party organizations jointly request instructions and report, they shall submit the report after consensus. If no consensus is reached, the relevant circumstances shall be explained.

Article 19 when asking for instructions on major matters from the party organization at a higher level, it is necessary to ask for instructions in advance, so as to give the party organization at a higher level sufficient time for research, judgment and decision-making. If there is no time to ask for instructions in an emergency and must be dealt with on the spot, it shall perform its duties in accordance with the regulations and carry out follow-up instructions and reports in a timely manner.

Periodic reports are made in accordance with the prescribed time. Special reports should be carried out in a timely manner according to the progress of work, and special reports that study and implement the spirit of important meetings and documents of higher-level party organizations should focus on reflecting the effectiveness of implementation, and should not blindly seek speed. Major matters assigned by higher party organizations shall be reported in accordance with the time limit. Sudden major events shall be reported in a timely manner, and the report shall be renewed according to the development and disposal of the event.

Article 20 A request for instructions shall state the matters requested and the relevant reasons. The request for instructions shall be submitted in one document, and shall not be included in non-soliciting official documents such as reports.

For major matters requested by lower-level party organizations, if the accepting party organization needs to ask for instructions from the higher-level party organization in its name, it should carefully study and responsibly put forward suggestions for handling, and must not only transfer the original text to the higher-level party organization.

Article 21 After the higher-level party organization receives the request, the comprehensive department generally puts forward the opinions of the proposed organization and reports it to the responsible comrades of the party organization for approval in accordance with regulations.

The party organization at a higher level shall take the lead in handling the request for instructions jointly submitted by the party and government organs.

Article 22 The higher-level party organization shall handle the urgent requests for instructions accepted as soon as possible. If there is a clear time limit for processing, the processing shall be completed within the prescribed time limit. If there are special circumstances that cannot be completed within the prescribed time limit, the situation shall be explained to the lower-level party organization on its own initiative.

Article 23 the reply to the request for instructions shall generally insist on who to ask for instructions and who will reply. Under special circumstances, the Party organization that accepts the request may authorize the relevant departments of the Party organization to reply on its behalf.

Article 24 The report shall have substantive content and reference value, which will help the higher-level party organization to understand the situation, make scientific decisions, and refrain from being empty, evaluating merits, and engaging in formalism. The report should be concise and to the point, and the style of writing should be simple. The comprehensive report submitted to the Party Central Committee is generally within 5000 words, and the special report is generally within 3000 words. The relevant contents of the report can be reflected in the annex if the situation is complicated and necessary.

Article 25 after receiving the report, the party organization at a higher level shall, according to the needs of the work, submit it to the responsible comrades of the party organization for reading. The comprehensive department may submit reports with the same theme and similar content in a unified and centralized manner, or submit the summary after forming a comprehensive material.

If the responsible comrades of the party organization give instructions on the report, the comprehensive department shall handle it in a timely manner in accordance with the requirements.

Article 26 Party organizations at higher levels shall strengthen the comprehensive analysis and utilization of reports. Typical experiences and practices with promotion value can be publicized in appropriate forms; common problems should be paid attention to and studied and solved; valuable opinions and suggestions should be carefully studied and absorbed to promote improvement.

Article 27 If there are circumstances that may affect the fair handling of the work of requesting instructions and reporting on major matters, the relevant personnel shall withdraw.

 

Chapter V Party Organizations Request for Instructions and Report Methods

 

Article 28 Party organizations shall request instructions and reports orally and in writing according to the types and priorities of major matters.

Article 29 If it is appropriate and convenient to request instructions and reports on major matters, they may be made orally. If the situation is urgent or the handling of major matters is still in the preliminary gestation stage, the report may be requested orally and subsequently supplemented in writing.

Article 30 The oral request for instructions and reports shall be made by telephone, face-to-face, meeting, etc. as the case may be. If the content is relatively simple or the situation is very urgent, the call method can be adopted; if the content is more complex or the situation is sensitive and special, the face-to-face method can be adopted; if the content is more formal or involves more subjects, the meeting method can be adopted.

The oral request for instructions shall be recorded and kept to ensure that it is well documented.

Article 31 Where the handling of non-emergency situations or major matters is at a relatively mature stage or is not suitable for simple and convenient reporting, a written form shall be adopted.

Article 32 The written report shall be in the form of formal reports, information, briefings, etc., as the case may be. Information focuses on reporting major emergencies, problems, phenomena and situations that need attention, and should be timely, efficient, authoritative and accurate. Briefings focus on a brief report on a particular area of work.

Party organizations should make good use of written reporting methods as a whole, adhere to the principle of "reporting one thing without two reports", and generally should not use multiple methods to repeat reports on the same content. If the party organization at a higher level explicitly requires a formal report, it shall not be replaced by other means.

Article 33 Party organizations may use telephone, documents, faxes, telegrams, networks and other carriers to carry out the work of requesting instructions and reports. Confidential matters shall be carried out in accordance with the relevant provisions on confidentiality.

The grass-roots party organizations can be more flexible and convenient to carry out the work of asking for instructions and reporting, and highlight the actual results.

 

Chapter VI Report on Request for Instructions from Party Members and Leading Cadres

 

Article 34 Party members shall generally request instructions from their party organizations to report major matters. Leading cadres should generally report important work to the party organization to which they belong.

Party members and leading cadres request instructions from the party organization to report personal matters, in accordance with the relevant provisions of the implementation.

Article 35 A Party member shall ask the Party organization for instructions on the following matters:

(I) important issues in engaging in the work assigned by the party organization;

(II) express propositions or make decisions on behalf of party organizations;

(III) foreign-related work contacts that require instructions in accordance with regulations;

(IV) transfer the party's organizational relations;

(V) other matters that should be asked for instructions from the party organization.

Article 36 A Party member shall report the following matters to the Party organization:

(I) the implementation of the party organization's resolutions and the completion of the tasks assigned by the party organization;

(II) opinions and suggestions on party work and leading cadres;

(III) the discovery of clues about violations of discipline by party members and leading cadres;

(IV) flow out of the situation;

(V) other matters that should be reported to the party organization.

Article 37 Leading cadres shall ask the Party organization for instructions on the following matters:

(I) major matters that are beyond the scope of their functions and powers and should be decided by the party organization to which they belong or by the party organization at a higher level;

(II) issues and situations that fall within its purview but are of great importance;

(III) express important opinions on behalf of party organizations;

The (IV) is unable to perform his duties or leaves the place where he works;

(V) other matters that should be asked for instructions from the party organization.

Article 38 Leading cadres shall report the following matters to the Party organization:

(I) study and implement Xi Jinping's thoughts on socialism with Chinese characteristics in the new era, and implement the important situations and issues in the decisions of the Party Central Committee and the party organization;

(II) abide by political discipline and political rules, resolutely safeguard the core position of General Secretary Xi Jinping's Party Central Committee and the core position of the whole party, and resolutely safeguard the authority of the Party Central Committee and centralized and unified leadership;

(III) adherence to democratic centralism, the promotion of inner-party democracy, the correct exercise of power and participation in collective leadership;

(IV) participation in the democratic life meeting of the leadership team and the organizational life meeting of the party branch (party group) where they are located;

(V) the fulfillment of the responsibility of governing the party, strengthening the construction of party style and clean government and anti-corruption work, and observing integrity and discipline;

(VI) major decision-making mistakes or improper handling of emergencies, important problems found in discipline inspection and supervision, inspection and audit, as well as violations of discipline and law;

(VII) major diseases that may affect the normal performance of duties;

(VIII) other matters that should be reported to the party organization.

Article 39 Party members and leading cadres shall request instructions and reports orally and in writing in accordance with regulations. Party organizations shall promptly handle requests for instructions from party members and leading cadres, and may study and deal with reported matters when necessary.

 

Chapter VII Supervision and Accountability

 

Article 40 The party organization shall include the development of the work of requesting instructions and reporting on major issues into the important content of reporting to the party organization at the next higher level.

Article 41 The party organization shall establish and improve the supervision mechanism for requesting instructions and reporting on major issues, and incorporate the implementation of the requesting and reporting system into the scope of daily supervision and inspection.

Article 42 The party organization shall take the work of requesting instructions and reporting on major issues as an important part of fulfilling the political responsibility of comprehensively and strictly governing the party, and conduct assessment and evaluation of lower-level party organizations and their main responsible comrades. The assessment and evaluation can be combined with the inspection and assessment of the responsibility system for the construction of party style and clean government, and the assessment of party building work, and the results should be notified in an appropriate manner.

Article 43: Establish and improve the error correction mechanism. For problems such as inappropriate subjects, inaccurate content, irregular procedures, and unreasonable methods in the work of requesting instructions and reporting on major issues, the higher-level party organization shall promptly remind and correct them, and reflect the relevant situation In the evaluation report.

Article 44: The accountability system for requesting instructions and reporting on major matters is implemented. Under any of the following circumstances, the relevant party organizations, party members, leading cadres, and staff members shall be held accountable in accordance with regulations and disciplines. If they are suspected of illegal crimes, they shall be in accordance with relevant laws and regulations Deal:

(I) violating political discipline and political rules by arbitrarily deciding on major matters that should be decided by the Party Central Committee and undermining the authority and centralized and unified leadership of the Party Central Committee;

(II) fail to fulfill their leadership responsibilities, do not attach importance to the request for instructions on major issues, do not deploy, and work is not carried out effectively;

(III) violation of organizational principles, the request does not ask for instructions, the report does not report;

(IV) lacking responsibility, shirking responsibility, turning in contradictions, and acting passively;

(V) engage in formalism, bureaucracy, the content of the request for instructions and the report is not true, the information is not accurate, resulting in serious consequences;

(VI) violates the work requirements and fails to ask for instructions and reports according to the prescribed procedures and methods, resulting in serious consequences;

(VII) other circumstances that should be held accountable.

 

Chapter VIII Supplementary Provisions

 

Article 45 The party committees of all provinces, autonomous regions, and municipalities directly under the Central Government, the central decision-making and coordination agencies, the central departments, and the party groups (party committees) of the ministries and commissions of the central state organs shall formulate specific implementation measures in close accordance with the actual work.

Article 46 The Central Military Commission may formulate relevant regulations in accordance with these Regulations and in the light of the actual conditions of the Chinese People's Liberation Army and the Chinese People's Armed Police Force.

Article 47 The General Office of the Central Committee shall be responsible for the interpretation of these Regulations.

Article 48 These Regulations shall come into force as of January 31, 2019.
