Opinions of the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council on Strengthening the Management and Control of Ecological Environment by Zoning


Ecological environment zoning control is to ensure the ecological function and improve environmental quality as the goal, the implementation of regional differentiation and precise control of the environmental management system, is an important measure to improve the level of modernization of ecological environment governance. Implementing ecological environment zoning control, strictly observing the red line of ecological protection, the bottom line of environmental quality, and the online use of resources, and scientifically guiding various development, protection and construction activities are of great significance for promoting high-quality development and building a modernization of harmonious coexistence between man and nature. In order to strengthen the regional control of the ecological environment, with the consent of the Party Central Committee and the State Council, the following opinions are hereby put forward.


  General 1. requirements
To strengthen the regional management and control of the ecological environment, we must adhere to the guidance of Xi Jinping's new era of socialism with Chinese characteristics, especially Xi Jinping's ecological civilization thought, thoroughly implement the spirit of the 20th National Congress of the Communist Party of China, implement the deployment of the National Ecological Environmental Protection Conference, implement the new development concept completely, accurately and comprehensively, accelerate the construction of a new development pattern, and coordinate the promotion of carbon reduction, pollution reduction, green expansion and growth. Fully respect for natural laws and regional differences, fully link up land space planning and use control, promote high-quality development with high-level protection, create a high quality life, and strive to build a beautiful China where man and nature coexist harmoniously.
-Ecological priority, green development. Adhere to respect for nature, conform to nature, protect nature, keep the boundary of natural ecological security and the bottom line of environmental quality, implement the responsibility of natural ecological security, and promote green and low-carbon development.
-Source prevention, system protection. Improve the source prevention system of the ecological environment, coordinate the integrated protection and systematic management of mountains, rivers, forests, fields, lakes, grass and sand, strengthen the protection of biodiversity, and strengthen the coordinated control of multiple pollutants and regional coordinated management.
-- Precise science, control according to law. Focus on regional, regional, prominent ecological and environmental problems, precise and scientific policy, in accordance with the law to establish a zoning classification and control strategy from problem identification to solution.
-Clear responsibilities, coordination and linkage. At the national level, we should do a good job in top-level design, local Party committees and governments should implement the main responsibilities, relevant departments should strengthen communication and coordination, establish a working mechanism of division of labor and cooperation, and improve policy unity, rule consistency and implementation coordination.
By 2025, the ecological environment zoning control system will be basically established, and a comprehensive, accurate and scientific ecological environment zoning control system will be initially formed. By 2035, an ecological environment zoning control system with a sound system, smooth mechanism, and efficient operation will be fully established, providing strong support for the fundamental improvement of the ecological environment and the basic realization of the goal of a beautiful China.







  2. comprehensively promotes ecological environment zoning control
(I) the development of ecological environment zoning control program. We will thoroughly implement the strategy of the main functional areas, fully implement the outline of the National Land and Space Planning (2021-2035), and formulate an ecological environment zoning management and control plan focusing on the implementation of the red line of ecological protection, the bottom line of environmental quality, and the online hard constraints of resource utilization, based on the ecological environment management and control unit, with the ecological environment access list as the means, and supported by the information platform. Adhere to the principles of national guidance, provincial-level overall planning, and municipal-level landing, and compile and release the ecological environment zoning control plan within the administrative area at different levels. The provincial and municipal ecological environment zoning control plan is organized and compiled by the government at the same level, fully connected with the "one map" system of land and space planning, and reported to the ecological environment department at the next higher level for filing and release for implementation.
(II) determine the ecological environment control unit. Based on the regional characteristics of ecological environment structure, function and quality, through environmental evaluation, on the basis of the management zoning of various ecological environment elements such as atmosphere, water, soil, ecology, sound and ocean, the results of "three zones and three lines" shall be implemented. On the basis of ecological protection red line, the protected area shall be drawn out and the priority protection unit of ecological environment shall be determined; taking the areas with high pressure of ecological environment quality improvement, high intensity of resource and energy consumption, concentrated pollutant discharge, serious ecological damage and high environmental risk as the main body, the areas with prominent contradiction between development and protection are identified, and the key control units of ecological environment are determined; the general control is implemented in other areas except the priority protection unit of ecological environment and the key control unit of ecological environment.
(III) the preparation of ecological environment access list. We will implement the negative list of market access, focus on solving outstanding ecological and environmental problems according to the functional positioning of the ecological environment and the requirements of land and space use control, systematically integrate existing ecological and environmental management regulations, accurately compile differentiated ecological and environmental access lists, and put forward requirements for controlling pollutant emissions, preventing and controlling environmental risks, and improving the efficiency of resource and energy utilization. The fine management of "one unit, one strategy" should be implemented according to local conditions. The priority protection unit of ecological environment should strengthen ecosystem protection and functional maintenance. The key control unit of ecological environment should strengthen pollutant emission control and environmental risk prevention and control in view of outstanding ecological environment problems. Other regions should maintain the basic stability of ecological environment quality. Where there is great pressure to improve the quality of the ecological environment, problems and risks are prominent, more precise control requirements should be formulated.
(IV) strengthen the ecological environment zoning control information sharing. Promote the information sharing and business collaboration between the national and provincial ecological environment zoning management and control systems and other business systems, and strengthen the supporting role of data management, adjustment and update, implementation and application, tracking and evaluation, and supervision and management. Promote the integration and innovation of a new generation of information technology, artificial intelligence, etc. and ecological environment zoning management and control, improve online government services and intelligent decision-making functions, and enhance service efficiency.
(V) co-ordination to carry out regular adjustments and dynamic updates. In principle, the ecological environment zoning management and control plan remains stable, and is adjusted regularly every five years in combination with the national economic and social development plan and the evaluation of land and space planning. If it is really necessary to update within five years, in accordance with the principle of "who publishes, who updates", on the basis of fully linking up the national economic and social development planning and land and space planning, dynamic updating shall be carried out and reported to the competent department of ecological environment at the next higher level for the record. If it is updated due to changes in major strategies and ecological environmental protection objectives, scientific demonstration shall be organized; legal protection areas such as ecological protection red lines, drinking water source protection areas, and nature reserves shall be established, adjusted or merged in accordance with laws and regulations, and laws and regulations If there are new provisions, they shall be updated simultaneously accordingly.






  3. boost high-quality economic and social development
(VI) service national major strategy. Through the regional management and control of the ecological environment, we will strengthen overall protection and systematic governance, support and optimize the layout of major productive forces, serve the construction of major national infrastructure, and ensure the implementation of major national strategies. We will implement the development strategy of the Yangtze River Economic Belt, promote the fine zoning and control of the whole Yangtze River basin according to units, strengthen the prevention and control of water pollution and environmental risks in heavy and chemical industries along the Yangtze River, and prevent heavily polluting enterprises and projects from transferring to the middle and upper reaches of the Yangtze River. We will implement the strategy of ecological protection and high-quality development in the Yellow River Basin, implement differentiated regional control in the upper, middle and lower reaches of the Yellow River, optimize the layout of energy, chemical and new energy industries in the middle and upper reaches of the Yellow River, and promote the green and low-carbon circular development of industries in the middle and lower reaches. Strengthen the application of ecological environment zoning control in the structural adjustment of industry, energy and transportation in Beijing-Tianjin-Hebei, Yangtze River Delta, Guangdong-Hong Kong-Macau Greater Bay Area, establish an ecological environment control mechanism of land-shore-sea linkage and regional integration, and guide the green and low-carbon transformation and upgrading of traditional manufacturing industries and the rational layout of strategic emerging industries.
(VII) promote green and low-carbon development. Implement the relevant national systems and policy requirements for high energy consumption, high emissions, and low-level project management, and guide the scientific layout and orderly transfer of key industries to areas with large environmental capacity, strong market demand, and good market guarantee conditions. Strengthen the management of key control units of the ecological environment, and promote the green and low-carbon transformation and upgrading of traditional industries such as petrochemical, chemical, steel, and building materials, and the transformation of cleaner production. Improve the construction of environmental infrastructure in industrial parks, and promote the development of industrial clusters and centralized pollution control. Connect the ecological environment access list, and guide the traditional industrial function space in the central urban area with high population density to retreat in an orderly manner. Optimize the management of ecological environment priority protection units, encourage the exploration of ecological product value realization models and paths, and enhance the ecological carbon sink capacity. Under the premise of ensuring the diversity, stability and sustainability of the ecosystem, support the construction of major national strategies, major infrastructure, and people's livelihood security projects. Implement the construction of large-scale wind power and photovoltaic bases in desert, Gobi and desert areas.
(VIII) support integrated decision-making. Strengthen the application of ecological environment zoning management and control results, and provide decision-making support for local party committees and governments. The evaluation of the effectiveness of the implementation of ecological environment zoning management and control is an important basis for optimizing the management of environmental impact assessment. Strengthen the guidance of ecological environment zoning control to enterprise investment, set up public access rights in accordance with laws and regulations on the ecological environment zoning control information platform, facilitate enterprises to analyze the compliance of projects with the requirements of ecological environment zoning control, and stimulate the development vitality of business entities.




  4. implementation of high-level protection of the ecological environment
(IX) maintain the ecological security pattern. Strictly implement the ecological protection red line control requirements. Focus on the red line of ecological protection, improve the quality of the ecosystem, and enhance the stability and service functions of the ecosystem. Strengthen the protection of biodiversity and improve the biodiversity protection network. Strengthen monitoring and early warning, take the initiative to adapt to climate change. For key areas such as the ecological barrier area of the Qinghai-Tibet Plateau, the key ecological area of the Yellow River, the key ecological area of the Yangtze River, the northeast forest belt, the northern sand control belt, the southern hilly mountain belt, and the coastal belt, the key areas are identified by unit to highlight environmental problems, and the differentiated control requirements for environmental governance are implemented.
(X) promote the improvement of environmental quality. Strengthen the implementation of ecological environment zoning control, form a closed loop of problem identification, accurate traceability, zoning policy, promote the solution of outstanding ecological environment problems, prevent structural and layout environmental risks, free up capacity for high-quality development, expand space. Deepen the regional management and control of the water environment in the basin, coordinate the management of water resources, water environment, and water ecology, strengthen the management of important water ecological spaces such as water conservation areas, river and lake waters and their buffer zones in the basin, and strengthen the prevention and control of agricultural non-point source pollution. Strengthen the ecological environment zoning control of coastal waters, land and sea co-ordination to promote the management of key estuaries and bays. Comprehensive consideration of atmospheric regional transmission law and spatial layout sensitivity, etc., to strengthen the division classification differential collaborative control. In accordance with the degree of soil pollution and relevant standards, the implementation of agricultural land classification management and construction land access management. Strengthen the management of acoustic environment, and promote the coordination of land use layout in large-scale transportation infrastructure, industrial concentration areas and noise-sensitive buildings. Explore the development of groundwater pollution prevention and control zoning control model, co-ordinate the ground and underground, and formulate differentiated ecological environment access and pollution risk control requirements.
(11) Strengthen the coordination of ecological and environmental protection policies. Give full play to the basic role of ecological environment zoning control in the source prevention system, and realize the fine management of global coverage, cross-departmental coordination and multi-factor integration. Strengthen the dynamic connection between ecological environment zoning control and land space planning, focus on the improvement of ecological environment quality according to the characteristics of development, protection and construction activities in different regions, and implement differentiated ecological environment management by unit. The competent departments of ecological environment and natural resources should select typical areas to carry out pilot projects, accumulate experience and improve mechanisms, so as to form a policy joint force. We will carry out collaborative pilot projects for ecological environment zoning control, pollution reduction and carbon reduction, and study and implement differentiated control policies based on carbon emissions and pollutant emissions. Strengthen the coordination of policies related to ecological environment protection and the ecological environment zoning control system, and incorporate the requirements of ecological environment zoning control into the formulation and revision of relevant ecological environment standards and policies. Encourage all localities to focus on industrial parks, free trade pilot zones, etc., to carry out coordinated and joint reform pilots such as ecological environment zoning control and environmental impact assessment, pollution permits, environmental monitoring, and law enforcement supervision, and explore the construction of a full-chain ecological environment management system.




  5. strengthen supervision and assessment
(12) Strengthen supervision and management. Relevant departments should, in accordance with the division of responsibilities, rely on relevant regulatory platforms, make full use of big data, satellite remote sensing, drones and other technical means to carry out dynamic monitoring, carry out on-site inspections of outstanding problems and hidden risks found, and strictly investigate and deal with them in accordance with the law. For the priority protection units of the ecological environment with significantly reduced ecological functions, the key control units of the ecological environment with prominent ecological environmental problems, and other areas where the environmental quality has significantly declined, strengthen supervision and law enforcement, and promote rectification within a time limit in accordance with laws and regulations. The outstanding problems existing in the implementation of the ecological environment zoning control system will be included in the central and provincial ecological environment protection inspectors.
(13) Improve the assessment and evaluation. The implementation of ecological environment zoning management and control will be included in the assessment of the effectiveness of pollution prevention and control, and the assessment results will be used as an important reference for the comprehensive assessment, reward, punishment, appointment and removal of local leading bodies and relevant leading cadres. The competent department of ecological environment of the State Council, together with relevant departments, tracks and understands the implementation of the work, and the effectiveness of the work serves as an important reference for the construction of the practical innovation base of "Green Water and Green Mountain is Jinshan and Silver Mountain.



 6. organization guarantee
(14) Strengthen organizational leadership. Adhere to the Party's leadership of the ecological environment zoning and control work. Local party committees and governments at all levels must strictly implement the "party and government with the same responsibility, one post and two responsibilities" for ecological environmental protection, improve the work promotion mechanism, regularly study the ecological environment management and control work, and normalize the promotion of sharing, adjustment and update, supervision and implementation, etc., Report the progress of important work in a timely manner, and form a good pattern of linkage between the upper and lower levels, each performing its own duties, and joint management. Each region may formulate supporting documents in combination with the actual situation.
(15) Strengthen departmental linkage. The competent department of ecological environment under the State Council shall, in conjunction with relevant departments, formulate and improve relevant policies on the management and control of ecological environment zoning. The development and reform departments should actively promote the full convergence of the results of ecological environment zoning management and control with the relevant plans for national economic and social development and the formulation and implementation of regional plans. The department in charge of natural resources should rely on the "one map" system of land and space planning, share data such as the red line of ecological protection, strengthen the connection between the ecological environment zoning control plan and the land and space planning, and jointly do a good job in relevant research and pilot work. The water administrative department is responsible for water resources management, water shoreline management and other related work, implements differentiated management of water resources, reasonably controls the scale of water resources development and utilization, and is linked with the ecological environment. Forestry and grassland authorities should strengthen the coordination and linkage between the management of various nature reserves and the management and control of ecological environment zoning. The relevant competent departments of industry and information technology, housing and urban-rural construction, transportation, agriculture and rural areas should, according to the division of responsibilities, strengthen the coordination and linkage between relevant work in this field and the zoning management and control of the ecological environment, and fully consider the requirements of zoning management and control of the ecological environment when formulating policies and plans for industry development and development and utilization, so as to reduce the negative impact on ecosystem functions and environmental quality. Relevant departments should introduce policies that are conducive to the implementation and application of ecological environment zoning management and control, and promote the coordination and linkage of supervision and law enforcement of ecological environment zoning management and control.
(16) Improve regulations and standards. Promote the incorporation of ecological environment zoning control requirements into the formulation and revision of relevant laws and regulations. Encourage localities with legislative powers to study and formulate local laws and regulations related to the zoning and control of the ecological environment. The competent department of ecological environment under the State Council shall, in conjunction with the competent department of natural resources, study and formulate the requirements for the division of ecological environment zoning management and control units and relevant standards and specifications.
(17) Strengthen capacity building. Strengthen the construction of related disciplines, scientific research and personnel training in the field of ecological environment zoning management and control, and accelerate the establishment of professional teams. Improve the construction of ecological environment zoning management and control information platform. Financial departments at all levels should comprehensively consider the objectives and tasks of their work and implement the guarantee of funds in accordance with the principle of dividing financial powers and expenditure responsibilities.
(18) Active publicity and guidance. The ecological environment zoning control into the party and government leading cadres education and training content. Strengthen publicity and interpretation, summarize and promote positive models in a timely manner, expose negative cases, and create a good atmosphere of widespread concern and common participation by the whole society.
